Licence Summary:

The Highway Authority may grant permission for placing of private apparatus along, over or across the adopted highway.

The private apparatus may be temporary or permanent. Typical examples may be a private telephone cable which spans a street between buildings, a small canopy on a building, sign on a building or CCTV equipment.

Certain projections over the highway require Planning Permission or Advertisement Consent, it is therefore essential you contact the Planning Department to establish their requirements prior to applying for a Highway Projection Licence.

Evaluation Process:

Where applicable, a valid Planning Permission / Advertisement Consent. The licensee must have a Public Liability Insurance of a minimum cover of £5 million and should indemnify the Highway Authority from and against all actions, claims, losses and expenses whatsoever in respect of personal injury or damage to property, however caused, arising out of or in anyway attributed to the projection.

To allow for the safe passage of pedestrians beneath projections from a building, such as canopies, blinds, CCTV equipment etc. a minimum vertical clearance of 2.3 metres is required from the surface of the footway to the underside of a projection and 0.75 metres clear of the road edge.

To allow safe passage of vehicles beneath cables etc. spanning the road between buildings a minimum vertical clearance of 6.0 metres is required.

If at a future date pavement furniture is added by the Highway Authority and the area of the licence is affected, the licence will be reviewed and may be amended or revoked.

Licence Holder Redress:

Any licence holder who wishes to appeal against a condition attached to, or the omission of anything from, their licence, or against the refusal to amend or replace a licence, or the service of a prohibition notice may appeal to the Crown Court.
