Contaminated Land

It is estimated that the UK has some 300, 000 plus hectares of land affected by contamination. Contamination is often associated with a previous industrial use, but it can also include farms and areas that have been used for waste disposal. Contaminants can range from oil, petrol, and heavy metals to solvents and pesticides.

Part IIA of the Environmental Protection Act 1990 was introduced through the Environment Act 1995 in April 2000. It requires local authorities to 'cause its area to be inspected from time to time for the purpose of identifying contaminated land' (section 78B).

The Secretary of State has issued Statutory Guidance on how to achieve this. It requires local authorities to adopt a strategic approach to inspecting their areas and to publish this approach in the form of a written strategy.

This inspection strategy has been produced by North East Lincolnshire Council to comply with these requirements and provide information on how the Council will approach its duty to carry out inspections.

The inspection strategy proposes a programme to systematically identify and prioritise contaminated sites in the area. In addition it recognises the need for urgent action where harm is being caused. This process will operate in parallel with existing remediation of contaminated land through conditions imposed under planning legislation.

The residents of North East Lincolnshire are encouraged to get involved in the identification of potentially contaminated land. This can be done by providing any relevant information and/or local knowledge relating to areas of land in the area that they may hold.
