Alleged Smell / Odour
You will appreciate that the Council cannot take action in respect of past and 'one-off' incidents. Before the local authority can consider formal action in respect of a complaint, it must first establish both by information from affected persons and by observations that a nuisance (in law) exists. For reasons which you will realise, it is important that the best use is made of time spent investigating complaints. Because there is a limit to the number of visits that can be made by officers hoping to witness and confirm a complaint, it is important that the best possible information is available to gauge the times when they are most likely to witness the nuisance complained of.
To proceed with a complaint you will need to complete the attached Smell Nuisance Record Form to record incidents that cause problems to you during the next two weeks and return it to:

Please tick the box next to your signature on the Smell Nuisance Record Form to indicate that you consent to the alleged offender being contacted and informed of the smell complaint details.

Any action which this authority then takes will be dependent on the information you provide. However, the authority would encourage you to make a direct approach to the person concerned, if you have not already done so. Smell complaints can often be settled amicably between the parties involved without local authority intervention. An informal approach is not only courtesy but also the first step in resolving any differences.
If the problem has ceased and the Record Form is not returned no further action will be taken. You would, however, be welcome to make a fresh complaint should the problem recur.
