About the Generic Development Control Policies
The Local Development Framework allows Councils to either contain a limited suite of policies within their Core Strategy or to prepare a separate Development Plan Document for this purpose. North East Lincolnshire Council have agreed to produce a separate Generic Development Control Development Plan Document.
Planning Policy Statement 12 guides Councils in the production of Local Development Framework documents. It states in preparing Generic Development Control Development Plan Document Councils 'should avoid producing a compendium of use-related development control policies' and that the focus should 'be on topic-related policies such as protecting resdiential amenity; protecting landscape and natural resources; nature conservation; addressing accessibility; highway and transport issues; protecting vitality and viability; and addressing visual impact etc.'
In addition the Generic Development Control Development Plan Document must have regard to National and Regional Planning Policy and inparticular how this applies to the Borough but without repeating these policies.
The Council is required to ensure that Generic Development Control Development Plan Document clearly defines circumstances when planning permission will, or will not, be granted and should focus on acheiving the outcomes required to meet the Councils Spatial Vision.
The Generic Development Control Development Plan Document must also be in conformity with the Core Strategy.
Consultation
The Generic Development Control Development Plan Document will undergo several stages of consultation as described in the Town and Country Planning (Local Development) (England) Regulations 2004. These include:
Regulation 25 Pre-submission consultation (issues)
Regulation 26 Pre-submission public participation (preferred options)
Regulation 28 Submission to Secretary of State (test of soundness)

Submission to Secretary of State
Development Plan Documents must be submitted to the Secretary of State for consideration and independent examination prior to adoption.
Independent Examination
The Secretary of State will appoint a Planning Inspector to carry out an independent examination. This involves assessing the document againt the Tests of Soundness. What happens next?
Following the independent examination the Inspector will issue a report which is binding on the Council instructing what changes if any should be made to the Generic Development Control Policies Development Plan Document. The Council can then adopt the Generic Development Control Policies Development Plan Documents.
