About Development Plan Documents

With regard to Development Plan Documents Planning Policy Statement 12: Local Development Frameworks states:

"The local development framework should include the following development plan documents:

i. core strategy;

ii. site specific allocations of land; and

iii. area action plans (where needed).

A proposals map illustrating the spatial extent of policies must be prepared and maintained to accompany all development plan documents. This may contain inset maps, where necessary.

In counties where there are districts, county councils will prepare minerals and waste development plan documents which will be included in a minerals and waste development framework. Development plan documents in unitary authority and National Park authority areas should include minerals and waste policies, which may be prepared as separate minerals and waste development plan documents.

All development plan documents must be subject to rigorous procedures of community involvement, consultation and independent examination to test the soundness of the document and ensure that the necessary legal requirements for its preparation have been undertaken. Development plan documents must be adopted after receipt of the inspector's binding report.

All development plan documents should clearly state when the document was adopted and in the case of the core strategy and any allocations development plan documents, the period of time which the document is intended to cover, in the form of month and year. There will normally be a number of development plan documents in the local development framework and conflict between policies should be avoided. The Act (Section 38(5)) makes clear that in the event of conflict the last adopted, approved or published policy will take precedence."

Consultation

The Development Plan Documents will undergo several stages of consultation as described in the Town and Country Planning (Local Development) (England) Regulations 2004.  These include:

Regulation 25 Pre-submission consultation (issues)

Regulation 26 Pre-submission public participation (preferred options)

Regulation 28 Submission to Secretary of State (test of soundness)

Submission to Secretary of State

Development Plan Documents must be submitted to the Secretary of State for consideration and independent examination prior to adoption.

Independent Examination

The Secretary of State will appoint a Planning Inspector to carry out an independent examination.  This involves assessing the document againt the Tests of Soundness.  More information on assessing the Tests of Soundness can be found on the Planning Inpsectorates web site using the following external link http://www.planning-inspectorate.gov.uk/pins/appeals/local_dev/Soundness_of_DPD.htm#guidance.

What happens next?

Following the independent examination the Inspector will issue a report which is binding on the Council instructing what changes if any should be made to the Development Plan Document.  The Council can then adopt the Development Plan Documents.
