Conservation/Constraints Information
Ancient Monuments
These are Nationally important monuments usually archaeological remains, that enjoy greater protection against inappropriate development through the Ancient Monuments and Archaeological Areas Act 1979. They can range from sites of primitive man through to second world war anti aircraft batteries.
The North East Lincolnshire Council currently has 11 Scheduled Ancient Monuments within its area.

Area of Outstanding Natural Beauty (AONB)
An area with statutory national landscape designation, the primary purpose of which is to conserve and enhance natural beauty. Together with National Parks, AONB represent the nation's finest landscapes and are designated by The Countryside Agency. North East Lincolnshire Council covers part of The Wolds Area of Outstanding Natural Beauty and properties sited within the AONB have their permitted development rights reduced e.g. a detached dwelling can only build an extension upto 50 cubic metres in size under permitted development rights instead of 70 cubic metres if it were outside of the AONB.

Article 4 Directions
Article 4 Directions are used to cover areas where the Council wishes to remove all or some of the permitted development rights relating to properties within that area - for example within a conservation area or the curtilage of a listed building. The North East Lincolnshire Council has 5 areas that have had Article 4 Directions placed on them. Each one removes certain permitted development rights within it.

Contaminated Land
It is estimated that the UK has some 300, 000 plus hectares of land affected by contamination. Contamination is often associated with a previous industrial use, but it can also include farms and areas that have been used for waste disposal. Contaminants can range from oil, petrol, and heavy metals to solvents and pesticides.
Part IIA of the Environmental Protection Act 1990 came into force in England in April 2000. It places responsibilities on local authorities to deal with contaminated land in accordance with a published Contaminated Land Strategy. Potentially contaminated land may also be addressed through the planning process.
The legislation requires that local authorities maintain a Public Register of Contaminated Land. Land on the public register is judged to meet the legal definition of contaminated land and has been formally identified in accordance with Part IIA of the Environmental Protection Act 1990. It is important to note that the public register does not contain details of sites of 'potentially contaminated land'.

Conservation Areas
These are areas of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance. Within Conservation Areas the Permitted Development rights are tighter than outside of the area e.g. The enlargement of a dwellinghouse consisting of an addition or alteration to its roof would require consent.
The North East Lincolnshire Council currently has 14 Conservation Areas.

Flood Risk Areas
These are generally low-lying areas adjacent to a watercourse, tidal lengths of a river or the sea, where water flows in times of flood or would flow but for the presence of flood defences. Listed Buildings
These are buildings of special architectural or historic interest that have been given statutory protection by English Heritage. The buildings are graded I, II* or II with grade I being the highest. Listing includes the interior as well as the exterior of the building, and any buildings or permanent structures e.g. wells within its curtilage. Please note that any unauthorised alterations to a listed building is a criminal offence.
The North East Lincolnshire Council currently has 228 Listed Buildings within its area.

Locally Listed Buildings
These are buildings that the Council feel enhance an area or are important buildings in their own right but have not been included in the list of buildings of special architectural or historic interest that have been given statutory protection by English Heritage. The Council would expect and encourage that any alterations to the buildings on this list are carried out to a high standard of design that would enhance the building and the surrounding location.

Permitted Development (or Permitted Development Rights)
Permission to carry out certain limited forms of development without the need to make an application to a local planning authority, as granted under the terms of the Town and Country Planning (General Permitted Development) Order. Numerous properties within North East Lincolnshire have had some or all of their permitted development rights removed by a planning condition or by an Article 4 Direction.
The PD Withdrawn Register is a list of properties that have had all or some their permitted development rights removed by a condition is updated on a weekly basis.

Tree Preservation Orders, Trees within a Conservation Area and Hedgerows
A Tree Preservation Order (TPO) is a mechanism for securing the preservation of single or groups of trees that have an acknowledged amenity value. A tree subject to a tree preservation order may not normally be topped, lopped or felled without the consent of the local planning authority.
