Use of Ordnance Survey (OS) Mapping in Connection with Planning applications submitted to the Council

Cessation of Ordnance Survey's Map Return Scheme

 Please note that on 30 September 2007 Ordnance Survey withdrew the Map Return Scheme whereby applicants could purchase appropriate maps to accompany their planning applications. Each purchase commanded a royalty fee which the Council subsequently paid back to Ordnance Survey (OS).

 Several options for a replacement scheme were considered but it has been decided not to enter into any partnership with the OS or with private suppliers of OS mapping. However, the OS and several private mapping companies offer a comprehensive service where applicants may purchase OS maps to submit with their applications.

 Applicants and agents are advised that the number and type of mapping required for individual applications are detailed in the Council's Application Checklist and the application notes that accompany each set of planning forms. These checklists and notes detail the number and scale of maps needed for each type of application. Applicants and Agents are advised to check these documents prior to placing any order for maps. The checklist and notes are available on the Planning homepage. If an application is submitted online via the Planning Portal copies of the relevant mapping can be purchased from the Portal at the time of submission.

 The list is in alphabetical order and is not in any order of preference. The Council does not recommend any particular one of these suppliers and any contractual arrangements, copyright and payment issues are entirely between the applicant and the supplier. Maps may usually be ordered on-line, by phone or in person from the outlet.

 OS have confirmed that a new set of maps must be presented with every submission, even if someone is resubmitting a previous application, e.g. following refusals or withdrawals, limited period renewals, submission of reserved matters and details in discharge of conditions, etc.  Also any maps/extracts must have been acquired with the right to be used as part of an application submission.

The Council will not treat applications as invalid solely if the OS maps appear to be in breach of copyright but, equally, it cannot be seen to ignore such breaches. Applicants and their agents are therefore strongly advised to ensure that any applications submitted to the Council are accompanied by OS derived mapping which is legitimately obtained and includes any relevant licence numbers or the Council's MRS stamp.

As from 1 July 2006 application submissions will randomly be checked to ensure accompanying OS maps are legitimately sourced.  OS Maps which do not contain an appropriate licence number/copyright disclaimer or have obviously been 'recycled' from earlier submissions or appear to have been based on OS data without proper acknowledgement may be referred to the OS Intellectual Property and Legal Department.
