EXPLOSIVES ACT 1875 TO 1976

Information for the guidance of applicants registering premises under the Explosives Acts

It is a requirement that persons in North East Lincolnshire wishing to keep and sell explosives in small quantities, shall register their name, trade and premises with the North East Lincolnshire Council.

The registration is for a year on the payment of the statutory fee and becomes renewable on 30th September each year. It is not transferable.

STORAGE REQUIREMENTS

Two standards of storage are recognised and can be registered as 'MODE A' and 'MODE B'.

MODE B

Allows up to 250kgs of fireworks to be stored. Of this quantity 50kgs can be kept in the shop area stored in a glass showcase, cabinet, drawer, cupboard etc.

The showcase (or other receptacle) must be kept locked if the public have easy access. However, it may be unlocked but closed if it is situated where it is not accessible to the public.

Weight calculation is fireworks minus packaging (packaging is cartons, boxes, head cards etc., not fireworks tubes).

MODE A

Allows up to 1000kgs of fireworks to be stored in a safe and secure separate building or a fireproof lockable room not attached to any living accommodation.

Weight calculations include packaging as fireworks must be kept in closed manufacturers packaging in this mode.

'MODE A' or 'MODE B' stores used for keeping fireworks must be used exclusively for that purpose.

Passageways and understairs must not be used as storage areas.

Ensure you have adequate storage provision to accommodate the quantity of fireworks to be stored. Bengal matches are not fireworks and must, therefore, be stored separately.

Sparklers are fireworks and must be stored as detailed above.

Fireworks, even in their own individual boxes, must not be exposed on open shelves, counters etc., nor in shop windows. For display purposes, dummies or empty boxes must be used.

SELLING

The amount exposed during a sale must be kept to a minimum and in no circumstances exceed 2kgs. Fireworks must not be hawked, sold or exposed for sale upon any highway, street, public thoroughfare or public place.

It is illegal to sell fireworks to anyone apparently under the age of 18 years.

SAFETY

Disconnect from the electricity supply any electrical fittings inside a showcase whilst it is being used for displaying fireworks.

Discourage customers from handling fireworks when making their choice.

Ensure that there is no smoking in any room where there are fireworks being sold, displayed or stored. Display "No Smoking" notices.

Label storage containers "Fireworks - Highly Flammable" and keep them closed.

Keep all passageways and stairways clear so that if a fire should occur escape is not obstructed.

Keep water type fire extinguishers handy and see that they are properly maintained (buckets of water and of sand are a useful standby).
