PUBLIC NOTICE
GATING ORDER NOTICE – Public Path linking Weelsby Road to Brunel Close
NOTICE IS HEREBY GIVEN that the North East Lincolnshire Borough Council propose to make a Gating Order that will effect the Public Path linking Weelsby Road to Brunel Close, Grimsby.
The purpose of the Order will be to restrict all public access through the highway, subject to those persons who are exempted from the restriction by the Order, at all times. It is proposed that a barrier will be erected at the Weelsby Road end of the highway to achieve the restriction of public access.
If the proposed Order is made, the alternative route available to pedestrians will be via Weelsby Road and Peaks Lane
This proposal has been made in response to the crime and anti-social behaviour that the Council is aware is occurring in the public path linking Weelsby Road to Brunel Close. The Council believes that the application of the restriction of public access to the public path linking Weelsby Road to Brunel Close imposed by the Order will assist in reducing the level of crime and anti-social behaviour occurring and improve the quality of life for the residents in the area.
A copy of the proposed Order is set out below in the Schedule to this notice and can be inspected at the Council’s Municipal Offices, Town Hall Square, Grimsby and Civic Offices, Knoll Street, Cleethorpes during normal business hours, along with all associated documents including the plan and the Council’s Justification for making the Order, these documents can also be accessed on the Council’s website (www.nelincs.gov.uk.)
Written representations or objections on the proposed Order can be made to the Council’s Director of Law and Democratic Services, Municipal Offices, Town Hall Square, Grimsby, North East Lincolnshire, DN31 1HU and they will only be considered by the Council if they are received by the Director of Law and Democratic Services no later than Friday 24th August 2007

NORTH EAST LINCOLNSHIRE BOROUGH COUNCIL PUBLIC PATH LINKING WEELSBY ROAD TO BRUNEL CLOSE GATING ORDER 2007 Section 129A of the Highways Act 1980
The North East Lincolnshire Borough Council (“The Council”) in exercise of its powers under Section 129A of the Highways Act 1980 (“The Act”) and all other enabling powers hereby makes the following Order:
1. This Order shall come into operation on the 2007 and may be cited as the North East Lincolnshire Borough Council Public Path linking Weelsby Road to Brunel Close Gating Order 2007
2. The public right of way along the highway described in Schedule 1 shall be restricted at all times and the restriction will continue until further notice subject to an annual review by the Council.
3. An alternative route for pedestrian access is described in Schedule 2.
4. Those persons described in Schedule 3 shall be exempt from the provisions of this Order and upon their request keys will be made available to them
5. The Council is hereby authorised to install, operate and maintain a barrier at the Weelsby Road end of the highway to enable the enforcement of the restriction. The person responsible for operating and maintaining the said barrier is the Council’s Executive Director of Environmental Services Municipal Offices, Town Hall Square, Grimsby, North East Lincolnshire DN31 1HU
6. The conditions set out in Section 129A of the Act have been complied with for the purpose of making this Order.
