Local landlords are being reminded to check that their rented properties comply with recently updated electrical safety standards.
The new standards came into force at the start of April and set out a number of expectations for landlords.
Under the updated legislation, Home Improvement Officers in North East Lincolnshire now have powers to enforce electrical safety standards on existing privately rented properties.
All new and existing tenancy agreements for private rented properties must now include an electrical report from the landlord when moving into the property.
Landlords must ensure that the following electrical safety standards in their properties are met when occupied:
• Confirm that all installations meet the standards set out in the 18th edition of the Wiring Legislation, which are published as British Standards 7671.
• Ensure all electrical installations in their rented properties are inspected and tested by a qualified and competent person at least every 5 years.
• Obtain a report from the person conducting the inspection and test which gives the results and sets a date for the next inspection and test.
• Supply a copy of this report to the existing tenant within 28 days of the inspection and test.
• Supply a copy of this report to a new tenant before they occupy the premises.
• Supply a copy of this report to any prospective tenant within 28 days of receiving a request for the report.
• Supply the local housing authority with a copy of this report within 7 days of receiving a written request for a copy.
• Retain a copy of the report to give to the inspector and tester who will undertake the next inspection and test.
• Where the report shows that further investigative or remedial work is necessary, complete this work within 28 days or any shorter period if specified as necessary in the report.
• Supply written confirmation of the completion of the further investigative or remedial works from the electrician to the tenant and the local housing authority within 28 days of completion of the works.
Tenants in agreements prior to 1 July 2020 should have received an electrical report by 1 April 2021.
Landlords failing to comply with the new legislation could face enforcement action and could receive fines of up to £30,000.

The Electrical Safety Standards in the Private Rented Sector 2020 come into force under the power granted to the Secretary of State under sections 122 and 123 of the Housing and Planning Act 2020. These regulations apply in England only.
