From 1 April 2021, Home Improvement Officers in North East Lincolnshire will have powers to enforce electrical safety standards on existing privately rented properties.
Changes to electrical safety standards legislation were initially introduced in June 2020, requiring all new tenancy agreements for private rented properties, after 1 July 2020, to include an electrical report from the landlord when moving into the property.
The same requirement will apply to all existing tenancy agreements from the end of this month, and local landlords are being urged to familiarise themselves with the updated legislation.
The legislation means that landlords have to ensure that the following electrical safety standards in their properties are met when occupied:
- Confirm that all installations meet the standards set out in the 18th edition of the Wiring Legislation, which are published as British Standards 7671.
- Ensure all electrical installations in their rented properties are inspected and tested by a qualified and competent person at least every 5 years.
- Obtain a report from the person conducting the inspection and test which gives the results and sets a date for the next inspection and test.
- Supply a copy of this report to the existing tenant within 28 days of the inspection and test.
- Supply a copy of this report to a new tenant before they occupy the premises.
- Supply a copy of this report to any prospective tenant within 28 days of receiving a request for the report.
- Supply the local housing authority with a copy of this report within 7 days of receiving a written request for a copy.
- Retain a copy of the report to give to the inspector and tester who will undertake the next inspection and test.
- Where the report shows that further investigative or remedial work is necessary, complete this work within 28 days or any shorter period if specified as necessary in the report.
- Supply written confirmation of the completion of the further investigative or remedial works from the electrician to the tenant and the local housing authority within 28 days of completion of the works.
Tenants in agreements prior to 1 July 2020 should receive an electrical report by 1 April 2021.
Landlords failing to comply with the new legislation will face enforcement action and could receive fines of up to £30,000.
