Part of Public Footpath 11, Grimsby Public Path Diversion Order 2021

HIGHWAYS ACT 1980 SECTION 119

This Order is made by the North East Lincolnshire Council (“the authority”) under section 119 of the Highways Act 1980 because it appears to the authority that in the interests of the owner of the land crossed by the footpath it is expedient that the line of the path should be diverted.

BY THIS ORDER

  1. The path over the land shown by a bold black line on the attached map and described in Part 1 of the Schedule to this order (“the Schedule”) shall be diverted, and the Definitive Map and Statement for Grimsby Rural District (now the Borough of Cleethorpes) shall be modified as provided below.
  2. There shall be created to the reasonable satisfaction of the authority an alternative highway for use as a replacement for the said Public Footpath as provided in Part 2 of the Schedule and shown by bold broken dashes on the attached plan.
  3. Where immediately before the date on which the path is diverted there is apparatus under, in, on, over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had

PART1
Description of site of the existing path

That the part of Public Footpath 11 from point A on the attached Order plan at Ordnance Grid Reference TA527000, 409711 which runs in an southerly direction for approximately 63 metres to point 8 at Ordnance Survey Grid Reference TA526992, 409650 where the path changes direction to south south easterly direction and runs for approximately 65 metres to point C where the path changes direction to south south westerly direction and runs for approximately 19 metres to point D at Ordnance Survey Grid Reference TA527013, 409591 where is runs and changes to a southerly direction for approximately 33 metres to point E, at Ordnance Survey Grid Reference 527005, 409544 where is meets the highway known as Fredrick Ward Way. For the avoidance of doubt the intention of this order is to stop up the highway described above.

PART2
Description of site of alternative highway

A length of Public Footpath commencing at point A on the attached plan at Ordnance Grid reference TA527000, 409711 where the path runs directly south for approximately 134 metres to point F on the attached plan Ordnance Survey Grid Reference 526997, 409578, then changes to a south easterly direction running approximately for 35 metres to point G at Ordnance Survey Grid Reference 527002, 409543 at the highway known as Fredrick Ward Way.
