NOTICE OF MAKING A PUBLIC PATH DIVERSION ORDER

HIGHWAYS ACT 1980 SECTION 119

Public Footpath 116, Aylesby Public Path Diversion Order 2023

On 6 September 2023, North East Lincolnshire Council confirmed the above order made under section 119 of the Highways Act 1980.

The effect Order is to divert Public Footpath 116 commencing at the layby on the A18, Aylesby at Ordnance Survey Grid Reference TA519545, 407575 the path turns to a north easterly direction and runs for approximately 8 metres to Ordnance Survey Grid reference TA519552, 407579, where it changes direction to a south easterly direction for approximately 17 metres to Ordnance Survey Grid reference TA519564, 407567, the path turns to an east north easterly direction and runs for 15 metres to Ordnance Survey Map reference TA519578, 407574, where the path turns to an south easterly direction for 22 metres to Ordnance Survey Grid Reference TA519595, 407558, where it changes direction to a south south westerly direction for approximately 22 metres to Ordnance Survey Grid reference TA519588, 407539 the path turns to a south easterly direction and runs for 40 metres to Ordnance Survey Map reference TA519614, 407513, the path turns to a easterly direction and runs for 25 metres to Ordnance Survey Grid reference TA519588, 407539, the path turns to a north north easterly direction for approximately 218 metres to Beach Holt Lane / Nooking Lane at Ordnance Survey Map reference TA519755, 407703.

A copy of the Order and the Order map have been placed and may be seen free of charge at Municipal Offices, Town Hall Square, Grimsby during normal office hours Monday to Friday. Copies of the Order and map may be bought there at a price of £10.

Any person who wishes to claim compensation under section 28 as applied by s121(2) of the Highways Act 1980 for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing addressed to Director of Economy, Environment and Infrastructure, North East Lincolnshire Council, Municipal Offices, Town Hall Square, Grimsby, DN31 1HU not later than 9 May 2024.

The Order will come into force 28 days from the date of this confirmation or on the day on which the Authority certifies that there has been created to the reasonable satisfaction of the Authority an alternative highway for use as a replacement for the said footpath as provided above (whichever is the later). But if a person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act 1980 as amended or on the ground that any requirement of the Act as amended or any regulation made under the Act has not been complied with in relation to the Order he or she may under paragraph 2 of Schedule 2 to the Act applied by paragraph 5 of Schedule 6 to the Act within 6 weeks from 2 April 2024 make an application to the High Court.
