North East Lincolnshire Council Public Footpath No. 43 Healing
Public Path Diversion Order 2021
This Order is made by the North East Lincolnshire Council (“the authority”) under section 119 of the Highways Act 1980 (“the 1980 Act”) because in the interests of the owner of land crossed by the footpath described in paragraph 1 of this Order it is expedient that the line of the path should be diverted.
BY THIS ORDER
- The path over the land shown by a bold black continuous line on the attached map and described in Part 1 of the Schedule to this order (“the Schedule”) shall be stopped up on the date on which North East Lincolnshire certify that work has been carried out to bring the site of the new highway mentioned in part 2 into a fit condition for use by the public, the Definitive Map and Statement for Grimsby Rural District (now the Borough of Cleethorpes) shall be modified.
- There shall be created to the reasonable satisfaction of the authority an alternative highway for use as a replacement for the said Public Footpath 43 as provided in Part 2 of the Schedule and shown by bold broken dashes on the attached plan.
- Where immediately before the date on which the path is diverted there is apparatus under, in, on, over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.
- The rights conferred on the public under the Order shall be subject to the limitations and conditions set out in Part 3 of the Schedule.
