Elections usually run in cycles, but if a seat becomes vacant a by-election can be called.

Casual vacancies

If a councillor leaves their seat during the course of their term, a casual vacancy occurs.

This could be due to –

  • the resignation of a councillor
  • the death of a councillor
  • the disqualification of a councillor
  • a councillor no longer being qualified

When a councillor’s seat becomes vacant, we will display a ‘Notice of Vacancy’ to advertise the vacancy.

To request a by-election, two local government electors from the relevant area must write to the Proper Officer. Once a request to hold an election has been received and validated, the date for polling day will be set within 35 working days of the date of receipt of the requests.

The exception is that if a casual vacancy occurs in the six months before the date on which that elected member would have retired, an election is not to be held, unless more than one third of the authority’s seats are vacant.
